They didn't exactly have a reason to release Arena and Daggerfall for free either.

At the very least I was told the gamebyro thing was the reason they can't release the engine's source when asked.

Not to sound rude but why would anyone care or want that? No one's going to make some huge engine revamp for morrowwind.

At the minimum painful number of hard coded things and absurd number of major bugs would be fixed.

In a weird way, this is actually a vindication of Naked Ninja's decision to use Torque and his justification for it.

Any small software company can go belly up, or get bought by a larger company with different business goals. Given enough time, most of them go this way. It's unfortunate for them (and us) that it was Torque that got hit this time.

But NN has said all along that the reason he chose Torque, despite there being alternatives with arguably better technology, is that Torque comes (came?) with full source code. Even without a company offering service or support, he can make any alterations and bug fixes he needs to -- and he'll be able to do that indefinitely.

If he had gone with Unity, and then Unity Technologies had gone out of business, he'd be in real trouble. That not as big a concern for the developers making quick, cheap games (for iphones or indie markets) -- but it's a very important consideration when developing an RPG with a five year plus development timeline.
