It's... complicated.

The entire team was laid off. Take 2 were suing 3D Realms over the Duke Nukem rights. But IIRC the company still exists in Broussard's basement.

That trailer looks really cool. The remix of the DN theme was pretty cool and I liked hearing the theme from Zero Hour there. I thought I heard some of Chris Kline's version too. Didn't care for the guy they had doing Duke's voice though, he's no John St. John by a long shot. Anyway, it's a shame the game will never be released, but the whole joke has been going on for way too long.
