That has to do with flatfootedness. As long as you haven't seen combat, you're still technically flatfooted. And flatfootedness means no dex to AC means sneak attack. The only way to counter is make sure your char is already in combat so he already has rolled for initiative, that way, you're sure he's already not flatfooted. (having had your initiative counts for not being flatfooted)

But when my character has already hit the attacking Rogue (presumably having won initiative), how the hell can the Rogue still be getting Sneak Attack on his first attack?

Thanks for the reminder about flatfootedness - I'd forgotten that, and it helps me understand the sitch much better. But there's still something fishy going on here.

And @kris - much of the l3wt is randomized, so yeah, getting the uber stuff early is a huge help. At level 9 now, Khelgar's still using a mace I found at lvl 3; it's significantly higher-damage than anything that's popped up since then. Otoh, I've seen no armor of any stripe above +1.
