Not quite how it works, "Apple" and "Windows" are both registered trademarks.My understanding was that one can't trademark a single english word of daily use. Vide Bethesda suing Mojang for the use of "Scrolls" and failing.
Blame the beyond retarded copyright laws in the US, not the developers. They are just following standard procedure.
I mean... I'd guess what they're doing is filing that and saying they're not going to force Banner Saga to change their name because they know if the issue is litigated they would lose. In a future case they may try to say "Look, we got an injunction here no problem, so you should give us one too" to a judge, but if they actually try to essentially make it impossible to use "Saga" in a title of a computer game, they're going to lose. American IP law isn't that intractable, but those guys just know they can bully people around, and in case a real competitor for their product comes up they want to have something they can pull out.As stupid as this sound this is how american trademark law works./10However, they have also said that they're not going to try and stop Stoic from using the name, they just had to file the injunction against them so that their copywright claim for the word Saga would be stronger against future would-be plagiarists.
