if he's telling his employees they've got benefits, and if he's collecting money for it (deducting from their paychecks), but not providing said benefits, that's possibly embezzlement and certainly fraud. both of which are illegal. that's what i originally stated as the possible crime. engaging in such misdeeds is not protected by the limited liability of incorporation...
