Characters with "lawful evil" ideas still exist, the mechanics are just not relevant to gameplay anymore.
So you could still have factions representing "Lawful Evilness" and "Chaotic Evilness", and they would still be recognizable as representations of different forms of evil; you just wouldn't have the "Ha ha, I geddit - these guys are the personification of the Lawful Evil alignment. Oh D&D, you so silly" moments.
