I was more pessimistic before, but a male conservative judge that roguey dug up evens the scales a lot.

It's impossible to make any sort of prediction on the outcome of the particular case because we don't know what kind of proof elements Avellone has handed to his lawyers. The initial petition might not need to exhibit all of it.

Pretty much every law system that has a judge has decision privilege for the judge. It is called freie Beweiswürdigung over here, roughly translated to "free evaluation of evidence". The opinions of the lawyer matter as much as the evidence. Also I kind of assume that Avellone will put a similar amount of evidence as that 1 hour youtube video + some extra stuff from his own vaults to the table.

Question for Americans, cos I don't really understand your legal system well, do reputable legal firms take on cases that are likely to be thrown out?

I would have thought they'd avoid doing that because it's bad for their reputation.

You must have forgotten the whole blompf clownesque "election fraud" lawsuits.

That's... actually the first non-terminal brain cancer post you've had in this thread. Yes, amended complaints and responses are a thing for that reason, in part to hint at what might be found during the discovery phase and to urge a settlement before then.

So I watched/listened to 80% of it in the background while working. what I gathered was:

1.) In CA naming 1-100 DOEs is common. Especially since he is coming up on the statute of limitations.

2.) He found the line about “hurt feelings” silly and unnecessary

3.) He mentioned that filing in CA can be somewhat of a honeypot for the defendants. In that CA may not have jurisdiction over them (Karissa/Kelly are out of state), but has such strong anti-SLAAP laws that they may be induced to accept jurisdiction with the thought of dismissing the case outright. However, if it doesn’t get dismissed, then it’s game on.

4.) As he went through the first page of complaints, he mentioned it will be difficult to prove the libel claims (IIRC, as I was kinda half listening)

Not sure if I missed it, but I didn’t see an overall conclusion at the end. The overall impression I got is that the suit isn’t overly unusual in its form for CA, that the lawyers seem to be legitimate, but it still may be a difficult case to win, depending on the trial (if it gets to that).

In which case, I would expect it to probably play out like 1.) try to dismiss, if win then case over. If lose then 2.) Settle and don’t go to trial.

I dunno. Im not a twitter lawyer or any form of lawyer.

Yeah, I don't see what the struggle to grasp this is. Chris lives in California -> He talks to lawyers in California (who are convenient and easily accessible for him) -> Chris goes to court in California.

It's also not at all unreasonable to consider that he may need to file suit a state or county where he can show significant damages, which may mean he has a company incorporated in the court's jurisdiction or used to live there. Further, a jurisdiction that services Hollywood is probably more used to libel suits, vis-a-vis who lives in Hollywood, than say Redwood CA or West Texas. Knowing that your complaint will land in a pool of judges who have some experience with your type of complaint is a double-edged sword, but I tend to agree that the law firm probably knows what it's doing much more than forum jockeys without an accomplishment to their name.

I don't get it. If he is so evil, a rapist, a monster, and so obviously guilty... instead of bringing him to twitter trial... why didn't they take him to court? Certainly in Liberal Kalifornia, even a wiff of this would meant him being found guilty even if he is innocent. Clearly the accusations are bullshit, and everyone knows it. That is why they shout it on the internet but not in a court room.
