Copyrights, licenses, and patents can be sold and purchased. The advantage of this system; whether you are talking about an author, composer, or game developer; is that it allows the “artist” to focus on what they do well, and have someone else purchase their creation and promote and distribute it. This is the reason most authors, composers, and developers work with publishers. Each focuses on what they do well and it is a mutually beneficial arrangement. Some of these arrangements give the original “artist” a residual income and some do not. It depends on the original arrangement, which is an agreement between the artist and the publisher/distributor. In any case, attempting to justify piracy because the user does not or cannot directly do business with the people who created the original content just removes the profitability from the distributor, who in turn becomes more selective regarding where they will put their money in the future. Does it actually make sense to buy games made by companies that do not exist now (except for collectable value)? I mean, the only one who gets money is the greedy publisher who didn't participate in the making of the game at all, so the cash won't go to the devs, reward their hard work and show them that the product is bought and people are interested so they need to continue releasing similar stuff.
My own opinion is that if it's not available in an acceptable form (discs if you want them instead of a digital copy, the language you want, new if you want a new copy...) and for a reasonable price you might as well torrent it. So you should buy Fallout, but you might torrent Torment. I bought Torment on eBay because I really wanted the actual CDs, and because I want to *own* the game, but I play it with disc images.
