How does the copyright in the case of TDM work? Aren't all fan Missions? Why is it ok to make a FM with garrett, hammerites, pagans and mechanists with the dark engine, and not with the dark mod?

I'm guessing it's OK to use Thief assets while playing Thief, as you have to use DromED anyway to make anything with it. But using Thief assets outside of the Thief game leads to legal hell, which the Dark Mod developers sought to avoid at all costs.

(Still leaves a few T2 Fan Missions in jeopardy as they've used assets from other games, but since the authors aren't making any money and acknowledging that they're using those assets has kept the legal hounds at bay.)

You could probably get away with it by not distributing the assets and requiring the person to own Thief to pull the assets out of it.

That seems like a good amount of hassle for little gain.

But are his missions related to official Thief lore?

If TDM named the main character Garrett, the hammer-wielding religious guys Hammerites, the more tech-oriented cult Mechanists and their leader Karras, while the city watch is led by a sherriff named Truart and some missions have you rob nobles named Bafford and Gervasius...
Then the game would use official Thief lore and that could lead to legal difficulties. Not that Eidos would actually care, considering how they're raping the setting of Thief anyway, but it would give them the possibility of legal action because the game would use Thief's IP.

If Garrett is supposed to be an enigmatic character, leave his past blurry, drop hints/tidbits throughout the game as to what he was and did, make sure there is more than one version of what happened and that no one account is more authentic than another, get the players thinking.
