It's a bit more complicated than that. The uncensored version of K&L2 isn't "banned" in Germany, it's on a government blacklist of media "harmful to minors". Any games on that list can't be sold publically. It basically works the same way video rental shops would treat pornography, it's strictly under the counter stuff - but it's not banned per se and it could be sold in theory. In practice this would mean that online game retailers would have to implement an "Adults Only" section that can only be accessed after you send them a copy of your ID. Squeenix went full retard with these blacklisted games (in particular K&L2 and Sleeping Dogs) and even disabled redeeming keys for the uncut versions for German users - despite there not really being any legal requirement to do so.
The way this particular release differs from previous gog releases of blacklisted games is that gog used to simply IP lock them instead of selling region-exclusive censored versions, and usually only after having the uncensored version available for a couple of days. I blind bought (and have since refunded) K&L2 fully expecting that I'd get the uncut version and that they simply hadn't implemented the IP lock yet. (In their pre-2015 glory days gog didn't bother at all with Germany's retardo censorship rules and just sold blacklisted/banned games to their hearts' content)
