For the 1000th time, it already is hosted in America.
The owner lives in Aus. Where the server is hosted has no bearing on the Aus law as it says the owner is responsible not the hosting company.
Edit: Should also be pointed out that judging from the other thread, the bit DU is more worried about is civil defamation/slander laws in Aus not hate speech. I.e. people suing him because they get insulted on the Dex.
