THE COMPANY WAS ACCUSED OF VIOLATING FEDERAL LAW BY MISLEADING SHAREHOLDERS ABOUT THE GAME

CD Projekt has agreed on settlement terms with a group of investors who sued the company over Cyberpunk 2077‘s disastrous launch.

A new statement released today states that negotiations were concluded on Wednesday and will see CD Projekt paying out just $1.85 million dollars to the plaintiffs.

“According to the Term Sheet, members of the class (including the plaintiffs) shall relinquish any and all claims against the Company and members of its Management Board,” the statement reads.

“In return, a settlement in the amount of $1,850,000 USD shall be paid out to the class by the Company and its insurer.

“As expressly stated in the Term Sheet, execution of the Term Sheet does not imply admission of any responsibility on the part of the Company or any of the other defendants named in the case.”

For comparison, CD Projekt made over $563 million in game sales during Cyberpunk’s release month alone, and spent just $2.2 million on its Help Me Refund campaign designed to provide refunds to players who were unable to claim one from the original vendor.

Following three delays, the highly anticipated Cyberpunk 2077 released in December 2020 with a host of technical problems, resulting in refunds being offered, the title being pulled from the PlayStation Store and CD Projekt shares tumbling.

Following the botched launch, a number of CD Projekt shareholders in the US filed class action lawsuits accusing the company of violating federal laws by misleading investors over the quality of Cyberpunk 2077, causing them to incur damages.

In May, CD Projekt confirmed that four class action lawsuits filed in the US had been consolidated and that a lead plaintiff had been appointed ahead of potential common court proceedings. These are the proceedings that have now been suspended as a result of the settlement.

At the time, business analyst Mike Futter analysed the financial report and noted that CD Projekt identified around $51 million as “provisions for returns and expected adjustments of licensing reports related to sales of Cyberpunk 2077 in its release window, in Q4 2020.”

Futter suggested that this referred to total refunds from all sources, as well as estimated refunds in 2021 that weren’t completed in time for the 2020 report.

“This language is confusing as hell (and likely intentionally so)”, Futter tweeted.

In June, CD Projekt said it believed Cyberpunk 2077‘s performance had reached a “satisfying” level, following six months of patches designed to improve the game.

The company recently delayed the PS5 and Xbox Series X/S versions of Cyberpunk 2077 from this year to the first quarter of 2022. When they’re released, they will be available as a free next-gen upgrade for players who own the current-gen editions.

And it would have of just worked (tm) if they hadn't fucked up the console port, and their damage control were up to Bethesda standards by just... igoring the problems.
But, it seems they asked him to share his wisdom again, as their new strategy is to re-release the next gen version and pretend nothing happened.

Arguably it did work. Recent reviews are positive on Steam, there is positive press coverage, it is still selling copies. It's back on consoles. Etc. I think the only mistake they made was not releasing a sloppy, unfinished game (a failure as a dev, but not as a businessman), but it was pissing off Sony. There is this public perception that Sony pulled the game from their store because it was uniquely broken, but this is obviously wrong. There are games much more broken than 2077 that Sony had no problem selling to people as a scam. What pissed Sony off was CDPR saying people could get refunds from them before first asking Sony if they could do that. You don't fuck with a corpo's territory. CDPR was like a small regional foodmart going up against Arasaka, and they got slapped down like the bitch they were.

If they hadn't done that I think the game would be seen publically as a success, and the complaints of it being buggy or broken would just be seen as whiny nerds in their basements complaining as they always do. It was stepping on their corporate relationships that really fucked CDPR in the... PR (heh) department.

They are aiming at GTA Online playerbase, good luck convincing those people to switch up and buy MTX for Cyberpunk Online or whatever that is going to be. Also good luck developing that if the core features (movement, shooting, driving, physics, UI, NPC AI) are fucked. Also good luck making money in next years if you are not going to fix the game. They are now announcing new content for Witcher 3 including "multiplayer features". Those fuckers know people are more likely to spend additional money on a functioning game than the broken one. And after so much flak I don't think they have enough willing people to work on CP2077 spaghetti, but just enough to keep building new small elements for Witcher.

As a business they have failed too. They have got money surge which they need to spend wisely because Twitcher will be soon handed out with polish passports. CP2077 won't be making enough noise to keep people interested in the franchise. They are investing in Anime but I don't think people will pick up CP2077 instead of Bladerunner 2049, Deus Ex or Ghost Runner.

I could easily end up being wrong, but I really don't see how this could possibly live up to the hype they've created.
Exactly same thing was said for Witcher 3 before its release..and for most people it met or exceeded expectations anyway.

Do you think they'd really do that?
Just hype their game up and tell people lies to sell copies?


To answer your questions above - no, I don't really think they'd blatantly lie just to sell copies. The reason is twofold. First is that they have pretty much everything riding on this game. If they hit the jackpot, they will go into the hall of fame for good, Witcher 4 will be hyped even more and they will swim in cash. If they fail however, they basically are done. You can't tell people that 'it just works' when it really doesn't and expect fans to keep being your fans and buy your next product. It just doesn't work this way.

The second reason is pretty trivial and Lord of Riva explained it pretty well.

I have my own reasons also but I'd like to keep those to myself.

No. It's all there and there are numerous mods making real use of it. I doubt you've dived into the Construction Set to check it..

It's tuned down in the official release (because obviously it's demanding, crap consoles can't handle it without it impacting on performance). Couldn't really care less since i didn't play it on console + i was smart enough to not play a Bethesda game at release. I "waited"(there are other games) like 2 years to play Oblivion, heavily modded, it was amazing and the A.I was awesome too.. I modded it to have other adventurers (like the player) raiding dungeons and looking to get rich etc. Really cool. I also modded it so that food was a must for every NPC, so they would go out and hunting if food was out of stock in the stores.

While he's been caught exaggerating and perhaps lying he's no worse than anyone else, probably one of the better when it comes to "AAA" games. CDPR are 100x times worse.

If the question is if you can make NPC's finish tasks using the radiant AI, then yes you can. Again, tons of mods expands on the radiant AI, what he described in the early interviews is nothing, you can do tons more with it than that.

Why not name some other RPG with more advanced AI when it comes to NPC's.. oh, you can't? what a surprise.
